Customer terms · version 1.1

The deal, in plain English.

Version 1.1, dated 22 October 2026. The short version comes first. The full terms follow it.

Agree to these terms

The short version

  • Build: $290, paid when your site goes live. Up to 8 pages. A quote form that emails you. Two rounds of changes. A preview in about a week. Live in one to two weeks from when you send your photos and prices.
  • Care plan: $35 a month. It covers hosting, your domain renewal, the security certificate, the quote form, a monthly check with a short enquiry summary, and up to 3 small changes a month. I reply within 1 working day and do small changes within 5 working days.
  • Cancel any time after the first month. Text or email me. No fee and no notice period.
  • You own your domain, your words and your photos. The domain is registered in your name. If you leave, you get your site files and your domain. You can take them to any web designer.
  • I own my code and design. You get a free, lasting right to use, copy and change your site once the $290 is paid.
  • Paying. Invoices are due in 7 days. If one is late I send a reminder. If it's still unpaid 14 days after the reminder, your site may be paused until it's paid. There are no late fees.
  • Your photos and text must be yours, or you must have permission to use them.
  • Your customers' details from the quote form go to you. I only handle them to deliver them, and I keep them safe.
  • Hosting runs on Cloudflare. It is very reliable, but nobody can promise 100% uptime. If your site is down for more than 3 days in a month, that month's care fee is free.
  • If I get something wrong, I fix it at no cost. My total liability is capped at what you paid me in the last 12 months, unless the law says otherwise.
  • Your rights under New Zealand law still apply. Nothing here takes them away.

The full terms

1. About these terms

1.1These terms are the agreement between you and me, Ollie Willats, trading as Tradeface.

1.2They apply when you tell me you agree, in writing. That can be the form on my website, a text or an email.

1.3If my website or a written message promised you something better than these terms, the better promise wins.

2. The build ($290)

2.1I build a website of up to 8 pages. Usually that is home, services, areas, about and contact.

2.2The build includes:

  • writing the words around your trade and your area, using what you tell me
  • a quote form that sends enquiries to your email
  • tap-to-call buttons and a layout made for phones
  • page titles and local details so Google can tell what you do and where
  • your Google reviews shown on your site, copied word for word, with your OK
  • setting up or tidying your Google Business Profile, if you give me access
  • a link and a printable QR card that take your customers straight to leaving you a Google review
  • testing on real phones before launch

2.3You get a private preview link in about a week.

2.4You get two rounds of changes on the preview. A round is one list of changes you send me at once. I make every change on the list.

2.5The site goes live about one to two weeks after you send me your photos, services and prices. This is a guide, not a fixed date. It mostly depends on how fast I get what I need from you.

2.6If you want to edit the site yourself, tell me before I start. I will set it up that way.

3. What I need from you

3.1Your business name, services, areas, rough prices and contact details.

3.2Some photos of your work. Phone photos are fine. Your logo, if you have one.

3.3Access to your Google Business Profile, if you want me to tidy it.

3.4Answers to my questions within about a week.

3.5If I hear nothing from you for 60 days, I will check in. If you don't reply after that, I may close the job. You pay nothing for a build that never went live.

4. The care plan ($35 a month)

4.1The care plan starts the day your site goes live.

4.2It covers:

  • hosting
  • your domain renewal each year
  • the security certificate (the padlock in the browser)
  • the quote form
  • a check each month that everything works, with a short text or email saying how many enquiries came in
  • updating the Google reviews shown on your site every three months
  • up to 3 small changes a month

4.3A small change is something like a new price, a new photo, new opening hours or a few lines of text. Unused changes don't carry over to the next month.

4.4I reply to texts and emails within 1 working day. I do small changes within 5 working days.

4.5If your site stops working, I start looking at it within 1 working day of finding out.

5. Extra work

5.1These cost extra: new pages beyond 8, a redesign, new features, photography, paid ads, and more than 3 changes in a month. Current prices for common extras:

  • a price calculator customers use to work out their own price: $90 once
  • a before-and-after photo slider: $40 once
  • an extra page: $40 once
  • a simple logo: $60 once
  • a "book online" button linking to a booking tool you already use: free

5.2I will always give you a price first. I only charge for extra work if you say yes in writing.

5.3Some extras need a paid outside service. One example is a form that gets more than 50 messages a month. I will tell you the cost before you decide.

6. Paying

6.1I send an invoice for the $290 build when your site goes live.

6.2I send an invoice for the care plan each month, at the start of the month it covers.

6.3Invoices are due 7 days after the invoice date. Pay by bank transfer, using the invoice number as the reference.

6.4Prices are in New Zealand dollars. I am not registered for GST, so there is no GST on top.

7. Late payment and pausing your site

7.1If an invoice isn't paid by the due date, I will send you a reminder.

7.2If it's still unpaid 14 days after the reminder, I may pause your website until it's paid. I will text or email you at least 2 working days before I do.

7.3While paused, your site shows a simple page with your business name and phone number. Your domain stays yours.

7.4Once you pay, I put the site back within 1 working day. There is no fee to restart it.

7.5I don't charge late fees or interest.

7.6If an invoice is still unpaid 60 days after its due date, I may end the care plan under clause 8.4.

8. Cancelling

8.1Before launch, you can stop at any time. You pay nothing.

8.2After launch, the first month of the care plan is the minimum. After the first month you can cancel any time. Text or email me.

8.3The care plan stops at the end of the month you have already paid for. No more invoices are sent. There is no cancellation fee.

8.4I can end the care plan too:

  • for any reason, with 30 days' notice in writing, or
  • with 7 days' notice, if an invoice is 60 days overdue or your site breaks clause 11 and you haven't fixed it after I asked.

8.5If I end the care plan for any reason other than unpaid invoices, I refund any care fees you paid for time after it ends.

9. When the care plan ends

9.1Within 5 working days of you asking, I will send you a copy of your site files. This is the finished site plus the source files, ready for any web designer to use.

9.2I will give you the code you need to move your domain to another provider. I will help you move it.

9.3I will keep your site online for up to 30 days after the care plan ends, at no cost, so you have time to move.

9.4After that, I take the site off my hosting. Your domain renewal is then up to you.

9.5If the $290 build fee hasn't been paid, clause 9.1 applies once it is paid. Your domain is yours either way.

10. Who owns what

10.1Your domain. I register your domain in your name, or your company's name. You are the domain holder. I only manage it for you while you are on the care plan.

10.2Your content. You own your logo, photos and business details. You also own the words I write for you about your business.

10.3My code and design. We agree that I own the code, layouts and design I create, even though you pay for the build. I reuse my general code and layouts for other customers. I never reuse your words, photos or logo.

10.4Your right to use them. Once the $290 is paid, you have a free right to use, copy, change and move your site's code and design. It lasts forever, even after you cancel. You can let another web designer work on it.

10.5My portfolio. I may show your site in my portfolio. Tell me if you'd rather I didn't, and I won't.

11. Your photos and text

11.1Everything you give me must be yours, or you must have permission to use it. This covers photos, logos, reviews and text.

11.2Don't send me photos taken from Google, other websites or social media unless you have permission.

11.3If I add photos myself, I only use ones I am allowed to use.

11.4If someone says content on your site breaks their copyright, I will tell you and take it down while we sort it out.

11.5If content you gave me breaks someone's copyright, you are responsible for the reasonable costs that causes. If something I chose breaks someone's copyright, I am.

12. Your customers' details (privacy)

12.1When someone fills in your quote form, their details belong to your business. You are responsible for them under the Privacy Act 2020.

12.2I handle those details only to deliver them to you and to keep the form working. I never use them for anything else. I never sell or share them.

12.3Form messages pass through Formspree, a form service based overseas, and land in your email. Your site is hosted on Cloudflare.

12.4I keep copies of form messages in the form service for no more than 90 days, then delete them.

12.5I protect my accounts with strong passwords and two-step login.

12.6If I find out your customers' details may have been seen by someone who shouldn't see them, I will tell you within 2 days.

12.7I add a privacy page to your site. It tells your visitors who collects their details and why.

13. Hosting and things outside my control

13.1Your site runs on Cloudflare. Cloudflare doesn't promise any uptime for the plan I use, so I can't promise 100% either.

13.2If your site is down for more than 3 days in total in a month, that month's care fee is free.

13.3I am not responsible for outages or changes caused by Cloudflare, Formspree, your domain provider, Google or your email provider. I will still help you get things working again.

13.4I can't promise your site will reach the top of Google. Nobody honestly can.

14. If something goes wrong

14.1I do my work with reasonable care and skill.

14.2If something I built doesn't work as agreed, tell me. I will fix it at no cost.

14.3I am responsible for loss I cause by not taking reasonable care. My total responsibility to you is limited to what you paid me in the 12 months before the problem.

14.4That limit doesn't apply where the law doesn't allow a limit, or where I acted dishonestly or caused harm on purpose.

14.5You are responsible for loss you cause, in the same way.

15. Changes to these terms or prices

15.1I may update these terms or the care plan price. I will tell you in writing at least 30 days before the change starts.

15.2If you don't like the change, you can cancel before it starts. No fee and no minimum period applies.

15.3Each version has a number and date, so we both know which one you agreed to.

15.4I won't hand this agreement to someone else without your OK.

16. Sorting out problems

16.1If you're unhappy, tell me first. I will reply within 1 working day and try to fix it.

16.2If we can't agree, either of us can go to the Disputes Tribunal.

16.3New Zealand law applies.

17. Your rights

17.1You may have rights under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986. These terms don't take those rights away.
